Terms of Service

Please read these Terms carefully before using Dhaka IT Club Limited’s products and services.

Dhaka IT Club Limited – Terms of Service

By purchasing, accessing, or using our services, you agree to the terms below. These Terms apply to hosting, domains, billing, the customer portal, and support services.

1) Acceptance of Terms

By using our services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use our services.

2) Eligibility

You must be at least 18, or have valid parental/guardian consent, to register and use our services.

3) Accounts & Security

  • You are responsible for your login credentials and for all activities under your account.
  • Notify us promptly of any unauthorized access or suspected breach.
  • You agree to keep account information (email, phone, billing address) accurate and up to date.

4) Acceptable Use & Prohibited Content

  • No illegal content or activities (malware, phishing, copyright infringement, hate/violent material, doxxing).
  • No unsolicited bulk email/spam, open relays, mass mailing lists without proper opt-in and compliance.
  • No crypto-mining, DDoS participation, port scanning, or abusive traffic generation.
  • No resale or sub-delegation that violates plan limits or these Terms.
  • We may involve law-enforcement and cooperate with valid requests where required by law.

5) Resource Usage Limits

Shared/Reseller environments have limits (CPU, RAM, I/O, processes, entry processes). If your usage impacts server stability/performance, we may throttle, isolate, or request an upgrade (e.g., VPS/Dedicated). Persistent abuse may result in suspension.

6) Payments, Billing & Taxes

  • Prepaid: Services are prepaid unless otherwise agreed.
  • Due Dates: Invoices are due on or before the invoice due date. Unpaid invoices may result in suspension after a short grace period.
  • Currency & Taxes: Prices may be shown in BDT/USD. Applicable taxes/fees (e.g., VAT) may be added.
  • Promotions: Intro/Promo pricing may apply for the first term only and can revert on renewal.
  • Chargebacks: Filing a chargeback or dispute may lead to immediate suspension/termination. Please open a ticket to resolve billing issues first.

7) Refunds & Cancellations

How refunds work: Approved refunds are sent to the original payment method; processing can take 5–10 business days depending on your provider.

Cancellations: Submit cancellations from your client area. You may choose “Immediate” (service stops and data may be removed) or “End of Billing Period.” Prepaid fees are non-refundable except as stated above.

Free domain / bundle offers: If your hosting plan included a free/discounted domain, the standard domain cost will be deducted from any refundable amount.

Chargebacks & disputes: Please open a billing ticket first. Chargebacks may result in suspension, account fees, and permanent restrictions.

Abuse/violations: Accounts terminated for AUP violations are not eligible for refunds.

8) Uptime SLA & Service Credits

We aim for 99.9% monthly uptime on shared hosting. If uptime falls below this due to our infrastructure, you may request a service credit within 7 days of the incident via ticket.

Exclusions: scheduled maintenance, customer-initiated actions, third-party app faults, DDoS or force majeure, upstream provider failures outside our reasonable control.

9) Suspension & Termination

  • We may suspend/terminate for non-payment, AUP violations, or security reasons (including urgent risk mitigation).
  • We may request remediation or an upgrade if your workload is not suitable for shared plans.
  • Upon termination, data may be deleted and cannot be recovered once purged.

10) Backups, Data & IP Addresses

  • Backups: We provide routine backups as a courtesy, but they are not guaranteed. You are responsible for maintaining your own off-site backups.
  • Content Ownership: You own your content; you grant us a limited license to host and process it to deliver the services.
  • IP Addresses: Any IP allocated remains our property or our upstream’s; it may be changed/reclaimed with notice where feasible.
  • Personal data is processed per our Privacy Policy.

11) Disclaimers & Limitation of Liability

Services are provided “as is” and “as available.” To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, revenue, goodwill, or data. Our aggregate liability for any claim relating to the services will not exceed the amount paid by you for the service during the three (3) months prior to the event giving rise to the claim.

12) Indemnification

You agree to indemnify and hold harmless Dhaka IT Club Limited and its personnel from any claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the services, or your breach of these Terms.

13) Governing Law

These Terms are governed by the laws of Bangladesh. Courts in Dhaka, Bangladesh shall have exclusive jurisdiction over disputes.

14) Changes to Terms

We may update these Terms from time to time. Changes take effect upon posting. Continued use after changes constitutes acceptance.
